RENTAL POLICIES & CONDITIONS

Reservations: A minimum of 30% down per reservation is required at time of booking and is non-refundable from Pensacola Getaways. Final payment is due in full 30 days prior to arrival. In the event of cancellation, refunds must be obtained from Red Sky Travel Insurance (if you elected to purchase travel insurance) and are subject to their policies and conditions. To protect against the loss of your rental payments, travel insurance is strongly recommended.

Rental Contract: You will receive a rental contract via email. Please read, sign and either fax to 850-304-0061 or scan and email to support@pensacolagetaways.com.

Accidental Damage Repair Service: Pensacola Getaways reservations require guest to pay a non-refundable Accidental Damage Repair Service which is a one-time charge per reservation that pays for accidental damage reported by the guest prior to check-out.

Damage to the property: Damage Protection: Pensacola Getaways reservations require guest to pay a non-refundable Accidental Damage Repair Service which is a one-time charge per reservation that pays for accidental damage reported by the guest prior to check-out. Damage to the Property: This fee pays for unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The cost of this program varies by property, for coverage up to $1,500 of unintentional damage. Any damages that exceed the $1500 will be charged to the credit card on file that you provided. Damages from negligence or wanton acts will be the lessees responsibility.

Travel Protection Insurance: Pensacola Getaways has partnered with Red Sky Travel Insurance to provide Sun Trip Preserver® coverage for our guests. Sun Trip Preserver provides cancellation and interruption services as well as emergency assistance and travel services. Protect yourself in the event of hurricane evacuations and family emergencies such as illness or death in the family. The travel insurance is optional and the cost is 6.95% of your total reservation stay.

Cancellation Policy: If you cancel your reservation for any reason, you will forfeit the 30% advanced payment. Should you cancel your reservation less than 30 days prior to your arrival, you will lose the total amount paid. No Exceptions. Once you have booked your dates, they will be locked in. We cannot accommodate date changes or reduce your length of stay. All cancellations must be made in writing stating that you understand you will be forfeiting your payment. Refunds for cancellations, changes or shortened stays due to actual or anticipated hurricanes, tropical storms or other inclement weather will not be issued under any circumstances. Refunds for natural disaster damage that make the property un-occupiable will not be issued under any circumstances. Refunds for events that may render the unit, area and/or amenities unavailable (to include but not limited to; natural or man-made disaster, owner usage, technical glitch, maintenance, pandemic, endemic, travel bans, health concerns, state of emergencies, ordered evacuations, local venue closure, community amenity closure, beach closure and/or the property remaining as a Pensacola Getaways rental at the time of the guests stay) will not be issued under any circumstances.

Occupancy: The total number of persons allowed in the property at any time is restricted to the stated limit for each property. Eviction without refund is the penalty. We are very serious about maintaining a family atmosphere for the quiet enjoyment of all our guests. We will rent to family groups and responsible adults only. MINIMUM AGE REQUIREMENT IS 25 YEARS OLD, AND HE/SHE MUST PHYSICALLY OCCUPY THE PREMISES FOR THE FULL TERM OF THE RESERVATION. No student groups allowed. Any reservation made under false pretense will result in forfeiture of rent and eviction. Identification is required at check-in for all reservations.

No parties, weddings, or gatherings are allowed without prior written permission from Pensacola Getaways. Absolutely no student groups or house parties will be tolerated.

All accommodations are governed by appropriate Florida Laws pertaining to Florida Landlord and Tenant Act, and also Rules and Regulations that are applicable to said premises. Occupancy of common areas shall be quiet and peaceful so as not to disturb others. These Rules and Regulations, where applicable, will be enclosed in your arrival packet along with any required parking permits and/or pool keys/passes for the condominium complexes, so be sure to go through them thoroughly.

Hurricane Policy: If a mandatory evacuation is issued by the National Hurricane Center or our local governing officials due to a tropical storm or hurricane threatening our area, refunds will be given by Red Sky Travel Protection if you purchased coverage before the storm was named. Pensacola Getaways will not issue refunds of any rent payments.

Payment: The rental payment is due in full 30 days before the day of check in. Reservations made less than 30 days before arrival must be paid in full immediately to be secured and are not refundable. Bank money order, check, or Visa/Master Card/Discover or American Express will be accepted as payment. Your final payment will be charged automatically 30 days before your reservation date. If you elect to pay your final payment by check, you must notify us when you book the reservation, and the check must arrive by the due date, which is 30 days before your reservation date. If your final payment check is more than 5 days late we reserve the right to cancel your reservation without refund. Optional services provided by outside agencies such as car, nannies or furniture rentals must be pre-arranged and paid for by guest through the agency of their choice. If you want a card charged Other than the CARD ON FILE for your final balance, you must notify us via email or phone before the final balance is due.

Check In/Check Out: Check-In is 4:00 P.M. CST or later. Due to our high standard of cleanliness, there is a possibility that your vacation rental may not be ready at 4:00 P.M. especially during peak seasons. Please do not enter the unit prior to the 4pm check in time unless approved by Pensacola Getaways Management. Failure to do so may result in a fee (unless early check in is prearranged and purchased, when possible). Check-Out time is promptly by 10:00 A.M. To avoid an extra cleaning charge; please wash the dishes, take out the trash, and leave the property in a neat and orderly condition.

  • Please return all keys, plus any parking permits to our office by 10:00 am. Do NOT leave keys in the property. All guests and belongings must be out of the property when the keys are returned to our office. If our office is closed when you check-out, simply drop your items in the “key drop” slot next to our front door. Failure to return keys to Pensacola Getaways upon departure will result in a $100.00 rekey charge. 
  • To avoid additional cleaning charges, please do the following before departure:
    • Remove all food from refrigerator.
    • Load dirty dishes into dishwasher.
    • Leave furniture arranged as you found it.
    • Remove all garbage and put in the outside receptacle.
    • Close and lock all windows and doors.
    • Please leave the property neat and orderly.

Late Night Arrivals – Please be considerate of your neighbors if making a late night arrival. Please ensure you have all necessary directions, door codes, parking passes, and/or security gate combinations. If you have trouble with the codes, call (850) 3040061 and leave message for on-call manager.

Items in your condo: Your condo will be supplied with

  • 4 bath towels, 4 hand towels, and 4 washcloths per bathroom 
  • 4 dishtowels and 4 dishcloths in kitchen 
  • 1 roll of toilet paper and 1 bar of soap per bathroom 
  • 1 trash bag for every trash can
  • Bed linens 
  • Kitchen is stocked with pots, pans, silverware, dishes, and glassware. Along with major appliances, a blender, coffee maker and toaster.

What to bring: paper towel, toilet paper, dishwashing detergent, dish soap, all purpose cleaner, trash bags, laundry detergent, bath soap, shampoo, coffee pot filters, hair dryer, beach items (towels, chairs, umbrellas, sunscreen). Don’t forget your camera!

Lockouts: If you lock yourself out of your property after office hours, you will need to call 850-304-0202. You will be responsible for paying a $250.00 After hours Lock out fee at that time. If you lock yourself out of your property during office hours, of course we will be happy to come let you in at no charge.

Parking:

  • Most complexes have parking permits that you will receive at check-in. There is a maximum of 2 permits per unit. Additional vehicles will need to be parked in a public parking lot. Display the permits on your dashboard or rearview mirror at all times. 
  • Most condos/townhomes prohibit boats, trailers, jet-skis, motor homes and buses.

Maintenance: The property owners and management work hard to ensure that the rental property and its amenities are in place and in good working order. Management will be available to handle questions, complaints and supervise maintenance issues. In case of a maintenance problem, management will strive to have the problem repaired as soon as possible after being notified. However, no refund or rate adjustment shall be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, telephone, television or cable service, appliances, plumbing, internet service, etc. It would be greatly appreciated if you would report any problems or damage immediately to management. **Please note** If you report a maintenance issue and it is deemed that nothing is wrong with the appliance or item you are reporting, you will be charged for the service call from either our maintenance group or the service contractor.

Garbage Removal: Please place household trash in appropriate receptacles (trash chutes, dumpster, or covered outside containers provided).

Grilling: Management and fire codes prohibit charcoal or open fire grilling on or under decks or balconies, or within ten feet of any structure. Please check property for designated grilling area.

Balcony: Do not hang towels or other items off of balcony. Do not throw items from balcony (minimum $50.00 fine and require litter pick up).

Owner Closets: Each property has a locked closet that has personal property of the owners. These locked closets are not to be tampered with or entered into. If evidence is found of disturbance/tampering into the owner closet, the penalty is $200.00 charged to the authorized credit card on file with your reservation.

Substitution: We reserve the right to substitute comparable accommodations without notice or liability in the event of a sale of the rental property or if the property becomes unavailable. In these rare instances we will try to notify you of the change. Units may not be sublet.

Indemnity: Pensacola Getaways will not be liable for any damages to rental property or furnishings, nor for injuries resulting from any accident that may occur in or on the premises during the guest’s occupancy. Pensacola Getaways will not be held responsible for acts of theft or vandalism or other damages to the guest’s personal items left in the unit.

Items left in property: Pensacola Getaways is not responsible for personal items left in a property. A $20.00 service charge plus shipping costs are required if you request Pensacola Getaways to pick up and mail the items back to you. Any items otherwise unclaimed will be considered abandoned after five days from your departure.

Pets: While our pets are important to us, unfortunately we cannot accept them in our rental properties. You will incur an additional charge if any evidence of a pet is found in your unit or on the premises. Having a pet in a rental unit without previous permission will void the contract and therefore be subject to eviction and forfeiture of any rental payments.

Units for Sale: In the event a property you are renting is listed for sale, we may find the need to show the property during your visit. We will make every effort to schedule the showing at a convenient time so we do not disturb your vacation.

Monthly Rentals: Some of our rentals do offer monthly rates which are available for the months of November, December, January and February.

TERMS & CONDITIONS:

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on {{reservation_date}} between the following:

Guest: {{guest_name}} (“Guest”), and

Host: {{host_name}} (“Host”).

THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

Hereinafter known as the “Premises.”

LEASE TERM. The Guest shall be allowed to occupy the Premises starting {{checkin_date}} from {{checkin_time}} and ending {{checkout_date}} at {{checkout_time}} (“Lease Term”).

PAYMENT. Upon reserving, 50% of the total reservation is due as a deposit. The balance is due 30 days prior to arrival. Pensacola Getaways makes every effort to communicate with guests regarding their reservation balance. If the balance is not collected 30 days prior to arrival, Pensacola Getaways reserves the right to cancel the reservation. Any payments made towards the reservation are forfeited.

BOOKING. Guest(s) reserving and occupying the rental must be over the age of 21. Guests under the age of 21 must be accompanied by a parent or guardian to reside in the unit. Parents and/or family members cannot book a stay for a group of students or young adults under the age of 21. Guests who break this rule will be made to leave without a refund.

CHECK-IN. Check-in begins at 4:00 p.m. At that time, you will complete the check in process and be given property access codes and directions. Delays may occur during peak periods as we carefully prepare your accommodations for your arrival. Early arrivals are not available last minute, so please plan accordingly.

CHECKOUT. Checkout is prior to 10:00 a.m. Late checkouts are not available last minute, additional fees will apply if there are no prior arrangements for late checkout and guest(s) depart after 10:00 a.m.

QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents.

OCCUPANTS. The total number of individuals staying on the Premises during the Lease Term shall be a total of {{number_of_guests}} guests. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host, or a fine of $100.00 per night, per person will be incurred.

GUEST POLICIES. You must be 21 years of age or older to reserve and occupy a residence. Photo ID and a valid credit card in the reservation holders name will be required at the time of check-in.

BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.

CANCELLATION POLICY. The cancellation policy allows cancellation no less than 30 days prior to your arrival for short term and no more than 60 days for long term. There will be a $199.00 cancellation fee. If cancelled for any reason, prior to 30 days for short term a 50% refund is given. There will be no refund for cancellation 29 days before your stay and your payment will be forfeited. If canceled for any reason, prior to 60 days for long term a 50% refund is given. There will be no refund for cancellation 59 days before your stay and your payment will be forfeited. We strongly recommend considering travel insurance to protect against unforeseen circumstances that may lead to cancellations. Changes to your reservation within 30 days of arrival, such as a decrease in nights or early departure are non-refundable.

TRAVEL INSURANCE. We recommend that you purchase travel insurance to help protect against financial loss if you must cancel your reservation for a covered reason. Pensacola Getaways offers a third-party product, Trip Preserver, which is available for most reservations and includes coverage for trip cancellation or interruption due to listed covered reasons, as well as additional benefits including coverage for losses due to trip delay or medical emergencies while traveling. If you elect to purchase Trip Preserver coverage for your reservation, we encourage you to review your insurance policy wording for all eligibility, benefits, terms, and conditions. VACATION RENTAL AGREEMENT

This Vacation Rental Agreement (“Agreement”) is for rental of the vacation rental property specified in a confirmed reservation (the “Property”). This Agreement is between: (1) Pensacola Getaways (“Pensacola Getaways,” “we,” or “us”), acting for itself and for the owner of the Property (“Owner”), and (2) the person who is the responsible renter of the Property (collectively “Renter” or “you”). By booking your rental of the Property with Pensacola Getaways, you acknowledge that you have read and understand, and agree to be bound by, all terms, conditions, and policies in this Agreement, including any Unit-Specific Terms (collectively, the “Terms”). Unit-Specific Terms. Certain jurisdictions, resorts, and specific homes require renters to agree to additional terms and conditions (“Unit-Specific Terms”). We will inform you during the reservation process of any Unit-Specific Terms that apply to rental of the Property. If any provision of Unit-Specific Terms differs from the Terms in this Agreement, the provision of the Unit-Specific Terms will control. Channel Terms. If you are booking through a third-party marketing channel, your booking may be subject to that channel’s own terms and conditions (“Channel Terms”). If any provision of applicable Channel Terms differs from the Terms in this Agreement, the provision of the Channel Terms will control. Meaning of “Pensacola Getaways”. Pensacola Getaways operates as Glenn Dorsey Inc, a Florida corporation, used in this Agreement, the term “Pensacola Getaways” means the entity specified in the Unit-Specific Terms, if any.

RENTAL POLICIES AND GENERAL TERMS

  1. Minimum Age. The “Minimum Age” to rent the Property is the age specified in any Unit-Specific Terms. If no age is specified in the Unit-Specific Terms, the Minimum Age is 21 years of age (or the minimum age required by law in the jurisdiction where the Property is located, if different). You agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests who are under the Minimum Age for the entire duration of the rental.
  2. Responsible Renter. As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over the Minimum Age, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.
  3. Good Neighbor Policy. Because the Property is a privately owned home, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Pensacola Getaways from police, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations.
  4. Maximum Occupancy. The number of people present at the Property may not exceed the maximum posted occupancy unless we have given you advance written permission to hold an event at the Property, in which case the number of people present at the Property may not exceed the maximum number of people authorized by Pensacola Getaways.
  5. No Smoking. No smoking is permitted at the Property (including porches, decks or outdoor areas) at any time. A $500.00 fee will be incurred and/or eviction.
  6. No Permanent Residence. You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.
  7. Animals. No animals or pets of any kind are permitted at the Property except (1) as specifically authorized in your reservation, or (2) bona fide service animals that we are required by law to allow. Emotional support animals are not permitted except as authorized pets. You agree that a prohibition on animals is not a guarantee than an animal has not been inside the Property or that the Property is free of animal or pet allergens. If the Guest is found to have pets on the Premises, this Agreement and any Security Deposit shall be forfeited. A $500.00 fee will be incurred and/or eviction.
  8. Events and Commercial Photography; Structures; Charcoal Grills. Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) No tents or other structures may be erected on the property without our express written permission. The use of charcoal grills is not permitted.
  9. Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property’s internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay.
  10. Payment Terms; Fraud. If you are paying by credit card you represent that you are the account holder or an authorized user of the account. If for any reason, Pensacola Getaways believes your payment may be refused by the card processor, Pensacola Getaways may ask you for a different form of payment. Upon Pensacola Getaways’s request, you will immediately provide another form of payment and adequate proof that you are the account holder or an authorized user of the account used for payment (such as a government-issued ID that matches the name on the account). Pensacola Getaways may cancel your reservation or remove you and all Occupants from the Property immediately if you fail to provide a form of payment that can be validated by Pensacola Getaways. We may share your credit card information and other information about you with law enforcement if we suspect fraud.
  11. Consequences of Breach; Charges for Damage. Any failure by you or any other Occupants to comply with any of the terms, conditions, or policies above is a breach of this Agreement and may result in a forfeiture of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. Pensacola Getaways may terminate this Agreement for breach, and if you are notified of such termination you agree to leave the Property immediately. In addition, you are responsible for, and you authorize us to bill your credit card on file for the full amount of: (1) any damage or loss that occurs at the Property during your stay; (2) a charge of up to $1,000 for violations of the pet policy, including for bringing more pets or different types of pets than specifically authorized; (3) an additional cleaning fee of up to $500 (or the actual cost of cleaning services, if greater) for violations of any of the guest policies above (other than the pet policy) or for excessive cleaning required by the acts or omissions of any Occupant during your stay; and (4) any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during your stay, and any damages (which may exceed the amount of fines) that result from the violation. If any unauthorized download of copyrighted material via the Property’s Internet service occurs during the period of your stay, you agree that we may share your contact information with the internet service provider or any other party we believe, for any reason, has enforcement rights.
  12. Cancellation Policy; No Shows. Unless stated otherwise in the home description and unit-specific terms, rental payments are fully refundable (less the amount of Pensacola Getaways’s booking fee, which is earned on receipt and becomes nonrefundable 24 hours after booking) for cancellations received 30 or more days before the first night of your reservation. No full or partial refunds will be granted for no-shows or if you cancel less than 30 days before the first night of your reservation, arrive after the first night of your reservation, or depart before the last night of your reservation. The cancellation policy allows cancellation no less than 30 days prior to your arrival for short term and no more than 60 days for long term. There will be a $199.00 cancellation fee. If cancelled for any reason, prior to 30 days for short term a 50% refund is given. There will be no refund for cancellation 29 days before your stay and your payment will be forfeited. If canceled for any reason, prior to 60 days for long term a 50% refund is given. There will be no refund for cancellation 59 days before your stay and your payment will be forfeited. We strongly recommend considering travel insurance to protect against unforeseen circumstances that may lead to cancellations. Changes to your reservation within 30 days of arrival, such as a decrease in nights or early departure are non-refundable. Except as expressly provided in this Agreement, no refunds or compensation will be given and Pensacola Getaways shall not be liable to you for failure to make the property available for occupancy if the property is unavailable or becomes partially or wholly unusable for any reason outside Pensacola Getaways’s control, including but not limited to adverse weather conditions, natural disasters, mechanical failures, evacuation orders or other acts of government agencies, or utility outages. Pensacola Getaways advises guests to obtain appropriate and comprehensive travel insurance that covers Renter and all Occupants and that includes coverage for personal injury, illness or disease, and property damage or loss.
  13. Travel Insurance. Pensacola Getaways advises guests to obtain appropriate and comprehensive travel insurance that covers Renter and all Occupants and that includes coverage for personal injury, illness or disease, and property damage or loss, and to help protect against financial loss if you must cancel your reservation for a covered reason. Trip Preserver coverage is subject to separate eligibility requirements, terms, and conditions. If you elect to purchase Trip Preserver coverage for your reservation, you acknowledge that Pensacola Getaways will be entitled to 45% of the fee you pay for such coverage. Trip Preserver is not available for rentals outside the United States or for reservations for properties within the United States that are booked by non-U.S. residents. N. Early Check-In/Late Check-Out. Early check-in or late check-out may be available; additional charges may apply. If you do not vacate by check-out time (or late check-out time as agreed by Pensacola Getaways), you authorize us to bill your credit card on file for a late departure fee of up to one night’s rental and we may remove all Occupants and their personal property from the Property.
  14. Maintenance or Housekeeping Issues; Property Conditions. The Property is provided as is, and we are not responsible for the inoperability or unavailability of any amenities. You agree to contact Pensacola Getaways, using the contact information provided in your confirmation email, as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. You further agree to give Pensacola Getaways a reasonable amount of time to respond to your report and to cooperate with Pensacola Getaways’s efforts to address the concern or provide a remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. You acknowledge that if the Property has access to amenities that are shared with other properties, such as a shared pool, hot tub, parking lot, or fitness center, that the availability and condition of those amenities is outside Pensacola Getaways’s control.
  15. Choice of Law; Jurisdiction and Venue; Dispute Resolution.

O.1. Choice of Law. Unless otherwise specified in any Unit-Specific Terms or if a different choice of law is required by the law of the jurisdiction in which the Property is located, this Agreement shall be governed by laws of the State of Florida, U.S.A, without regard to its conflict-of-law provisions.

O.2. Dispute Resolution and Arbitration Agreement: United States. If (a) your claim relates in any way to a reservation for or stay at a Property located in the United States, or (b) you bring any other claim against Pensacola Getaways in the United States (to the extent permitted by this Agreement), then you agree to resolve any dispute arising out of or relating in any way to this Agreement as follows:

  1. a) Agreement to Arbitrate. Except as otherwise provided in this section, you and Pensacola Getaways mutually agree that any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Payment of filing, administration and arbitrator fees will be governed by the AAA’s rules. To begin an arbitration, a party must send a letter to the other party requesting arbitration and describing the claim. If Pensacola Getaways requests arbitration, it will send the letter to your most recent email or physical address in Pensacola Getaways’s records. If you request arbitration, you must send the letter to Pensacola Getaways’s registered agent in the state in which the Property you reserved or stayed at is located, or if the dispute does not involve a reservation for or stay at a specific property, to Pensacola Getaways’s registered agent in the state of Florida.
  2. b) Place of Arbitration. Except as otherwise required by AAA’s Consumer Arbitration Rules, the arbitration shall take place in the county in which the Property is located, or in Pensacola, Florida, if the dispute does not involve a reservation for or stay at a specific property, or in such other location as you and Pensacola Getaways may mutually agree.
  3. c) Exceptions to Arbitration Requirement. As the only exceptions to the parties’ agreement to submit all disputes to binding arbitration as provided herein, Pensacola Getaways and Renter both retain the right to pursue: (1) in small claims court in the county in which the Property is located (or if the dispute does not involve a reservation for a specific property, the small claims court for Escambia County, Florida), any claim that is within that court’s jurisdiction, and the parties consent to the personal jurisdiction and venue of such court, and Pensacola Getaways further consents to Renter’s appearance by telephone or video in lieu of personal appearance, if allowed under applicable court rules; and (2) a suit in any court with jurisdiction to enjoin (whether by temporary, preliminary, or permanent injunctive relief) infringement or other misuse of intellectual property rights.

O.3. Dispute Resolution: Properties Outside the United States. If your claim relates in any way to a reservation for or stay at a Property located outside of the United States, you and Pensacola Getaways agree to bring any action in the courts of the country in which the Property is located, or in such other location and forum as you and Pensacola Getaways may mutually agree.

O.4. Class Action and Jury Trial Waiver. The parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, the parties waive any right to a jury trial.

  1. Acknowledgment & Disclaimer; Limitation of Liability.

P.1. Acknowledgment & Disclaimer. You acknowledge the Property may have features, amenities, and conditions that are unfamiliar to you and other Occupants you invite to the Property. You further acknowledge that your use of the Property and its amenities may carry inherent risk, including risk of bodily injury, illness or disease, disability, or death. For example, some Properties include natural habitats for wildlife, insects, and pests that may expose you to injury or disease; or docks, stairways, porches, ledges, cliffs, hot tubs, and other unmarked natural or manmade features, amenities, and conditions that carry inherent risk. You agree that, by using the Property or its amenities, you voluntarily and willfully assume those risks and assume full responsibility for the choices you make before, during and after your use of the Property and its amenities. You also acknowledge and agree that you and any other adult Occupants are solely responsible for closely supervising and protecting the health and safety of any and all Occupants that are minors, throughout the duration of your stay.

P.2. Disclaimer of Warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENSACOLA GETAWAYS AND OWNER EACH EXPRESSLY DISCLAIM ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND AS TO THE ADEQUACY OF THE DIRECTIONS AND WARNINGS PROVIDED TO YOU.

P.3. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY OR PENSACOLA GETAWAYS, NOR THEIR AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, ILLNESS OR DISEASE, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF PENSACOLA GETAWAYS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

  1. Indemnity. You agree to hold harmless and indemnify Pensacola Getaways and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, illness or disease, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay.
  2. Substitution of Property. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, Pensacola Getaways reserves the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. In the event of a substitution of rental properties, all Terms in this Agreement, plus any Unit-Specific Terms specific to the substituted property, shall apply to your stay in the substituted property.
  3. Assignment. Pensacola Getaways may assign this Agreement or any of its rights, or delegate any of its duties under this Agreement, at any time without your consent.
  4. Sex Offender Registry Check. In certain U.S. markets, we are required to run a search of the U.S. sex offender registry, consistent with applicable law. In connection with this Agreement, you authorize Pensacola Getaways to order a sex offender registry check about you through a third-party consumer reporting agency: Guest Ranger LLC, 15475 N Greenway Hayden Loop b2, Scottsdale, Arizona 85260 / phone 480-628-0010 / Guestranger.com.

UTILITIES. The Host shall be responsible for all utilities and services to the Premises EXCEPT for the following: None.

LIMITED DAMAGE WAIVER (LDW). At the time your reservation is confirmed, a Limited Damage Waiver fee is applied to your account. The renter agrees to pay a non-refundable damage waiver fee of $125.00. In exchange, the owner agrees to waive the renter’s liability for accidental damages to the property or its contents, up to $1,500.00. This waiver covers accidental damage caused by the renter during the rental period, such as spills, broken items, or minor property damage as long as the damage is reported PRIOR to checkout. Please report spills, breakage, and damage as soon as it occurs during the stay so we may assess and/or minimize the extent of the damage. However, this wavier does not cover intentional damage, negligence, or damages resulting from illegal activities. The renter agrees to promptly report any damages to the rental agency, Pensacola Getaways. Any damages exceeding the $1,500.00 limit will be the responsibility of the renter. This fee eliminates the necessity for additional security deposits. Again, the Limited Damage Waiver is ONLY valid if the incident is reported PRIOR TO CHECKOUT. By signing, the renter acknowledges and accepts the terms of this limited damage waiver.

The person whose name appears on the credit card is covered and must be present during the dates of stay to receive the benefits of the LDW. Any loss, theft, or careless or intentional damage (such as wall damage, or moving furniture) is the guest(s) sole responsibility and is NOT covered by the damage waiver. To avoid additional charges please ensure the following:

* All access fobs and keys are in the home and not missing – additional fee applies if not left in the unit

* No linens, towels, or household items are broken, unusable, or missing – additional fee applies if not left in the unit

* Checkout is on time – additional fee applies if not left in the unit

* No smoking in the unit – additional fee applies if not left in the unit

* No pets in the unit – additional fee applies if not left in the unit

* No more than the number of people allowed in the unit – additional fee applies if not left in the unit

HOUSEKEEPING. Your reservation includes cleaning upon departure. Housekeeping fees are included in the total.

GOLF CARTS, MOTORCYCLES, R.V.’S, BOATS, AND TRAILERS. Are not permitted. A $500.00 fee will be incurred and/or eviction.

SUBLETTING. The guest does not have the right to sublet the Premises.

INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any debit/credit card that is one file if Guest causes damage to the Premises or its furnishings.

TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Host.

QUIET ENJOYMENT. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.

ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney’s fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.

ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.

POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.

You will be charged for any missing or damaged linens.Be aware that the use of spray sunscreen will cause yellow stains on the laundry. If we are unable to remove them we will have to charge you the replacement fee. ns for anything other than bed and bath.
